Since July 12th, 2021, Arizona residents can clean some marijuana-related convictions, thanks to the passage of Proposition 207. This proposition is called the Smart and Safe Arizona Act.
Arizona voters passed prop 207 last November 2020. The proposition decriminalized the use of marijuana for recreational purposes. In addition, this allows the expungement of past records for certain low-level offenses.
We already blogged about this issue some months ago. Follow this link for more info.
What type of Marijuana Convictions Qualify?
Not all marijuana-related convictions will qualify. The convictions are limited to these:
⦁ Transporting, consuming 2.5 ounces or less of marijuana
⦁ Cultivating or processing no more than six marijuana plants at your primary residence for your personal use
⦁ Paraphernalia: using items related to cultivating, processing, manufacturing, or consuming marijuana
What is expungement?
Expungement is the legal process of cleaning up criminal records. This is a great opportunity to give many a fresh start in their lives.
In addition to citizens, non-citizens will also have the opportunity to access this process.
Expungement is a great benefit.
“This new opportunity provides a sense of justice, especially for young people of color who want to contribute to society with clean records,” said Attorney Marcos E. Garciaacosta
The benefits of the record expungement are varied, among them the rights to:
Own and possess firearms
Vote and serve as a jury
Hold public office
Secure professional licenses for professions such as stylists, contractors, bar owners, teachers, physicians, lawyers, etc.
The opportunity to obtain loans funded by the government, including housing
Additionally, some non-citizens (DACA, green-card holders) can avoid deportation and access potential immigration benefits
How much it cost?
You can do the process yourself in Maricopa County following this link. Law firms are charging between $1,000 and $2,000 for filing a regular case. If there are more complications, the cost may rise.
It is recommended you hire an attorney for the process.
